TERMS & CONDITIONS
1. Who we are
Funkum.studio is operated by Myceron s.r.o., Orešianková 9162/15, 840 08 Bratislava – mestská časť Záhorská Bystrica, Slovakia, a company registered in Slovakia.
- Company ID (IČO): 56937253
- Tax ID (DIČ): 2122509048
- VAT ID (IČ DPH): SK2122509048
- Registered in the Commercial Register of the Municipal Court Bratislava III, Section: Sro, Insert No. 187624/B
- Email: info@funkum.studio
In these terms, “we” and “us” mean Myceron s.r.o.; “you” means the person using the service.
2. The service
Funkum.studio lets musicians upload audio, images, video and related files, organise them into versioned releases and collections, credit collaborators, and share or stream that material through public pages and share links.
We may change, add or withdraw features. Where a change materially reduces what a paid plan provides, we will tell you in advance and you may cancel.
3. Your account
- You must be at least 16 years old to create an account.
- You sign in with a Google account. You are responsible for keeping access to it secure.
- You must give accurate information and keep it up to date.
- You are responsible for everything done through your account.
- One person or organisation per account; do not share credentials.
4. Subscriptions, prices and payment
- Starter — €2.99 per month, 1 GB of storage.
- Pro — €4.99 per month, 10 GB of storage.
Prices are shown in euro and include Slovak VAT. A subscription is required to upload content; browsing and streaming are free. Payment is taken monthly in advance by our payment provider, Stripe. We never see or store your card details.
Subscriptions renew automatically each month until cancelled. You may cancel at any time from your profile; cancellation takes effect at the end of the paid period, and you keep access until then. We do not refund part-months, except where the law requires it.
If you upgrade from Starter to Pro, the change takes effect immediately and the difference is prorated onto your next invoice. If payment fails, we may suspend uploading until it succeeds.
We may change prices with at least 30 days’ notice. If you do not accept a new price, you may cancel before it takes effect.
5. Right of withdrawal (consumers in the EU)
If you are a consumer, you normally have 14 days to withdraw from a distance contract without giving a reason. By subscribing you ask us to begin providing the service immediately. You acknowledge that once we have fully performed the service within the withdrawal period, and you have expressly agreed to that, you lose the right of withdrawal for that period under Article 16(a) of Directive 2011/83/EU.
To withdraw within the period, email info@funkum.studio with a clear statement. We will refund payments received, less an amount proportionate to the service already provided.
6. Your content
You keep all rights in everything you upload. We claim no ownership of your work.
So that we can operate the service, you grant us a non-exclusive, worldwide, royalty-free licence to store, copy, encode, transcode and transmit your content strictly for the purpose of providing the service to you and to the people you share it with. This licence ends when you delete the content, apart from copies retained briefly in backups.
You confirm that:
- you own your content, or have all rights needed to upload and share it;
- it does not infringe anyone’s copyright, trade marks, privacy or other rights;
- any collaborator you credit has agreed to appear, and the splits you record are accurate.
Credits and percentage splits recorded on a release are a record you maintain between yourself and your collaborators. We do not verify, mediate or enforce them, and they do not create any payment obligation on us.
7. Acceptable use
You must not use the service to:
- upload or share anything unlawful, infringing, defamatory, or that depicts or promotes abuse;
- distribute malware, or attempt to breach, overload or probe our systems or accounts;
- circumvent storage limits, access controls or share-link restrictions;
- scrape or bulk-download other users’ content;
- impersonate anyone, or misrepresent your association with a person or group.
8. Reporting infringing content
If you believe material on Funkum.studio infringes your rights, email info@funkum.studio with enough detail to identify the material and your claim. We will review it and, where appropriate, remove the material and notify the user who uploaded it, who may respond. We may suspend accounts that repeatedly infringe.
9. Availability
We aim to keep the service available but do not guarantee uninterrupted operation. Maintenance, faults or problems at our providers may cause interruptions. We are not liable for interruptions outside our reasonable control.
You are responsible for keeping your own copies of anything you upload. The service is not a backup service.
10. Suspension and termination
You may stop using the service at any time and delete your account from your profile. You must cancel any active subscription before deleting your account, because deletion removes your access to the billing portal.
We may suspend or terminate your account if you seriously or repeatedly breach these terms, or if we must do so by law. Where it is reasonable, we will warn you first and give you an opportunity to export your content.
11. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be limited under the law — including your statutory rights as a consumer.
Subject to that, we are not liable for indirect or consequential loss, lost profits, lost opportunities, or loss of data where you have not kept your own copies. Our total liability in any twelve-month period is limited to the amount you paid us in that period.
12. Privacy
Our Privacy Policy explains what personal data we process and the rights you have over it. It forms part of these terms.
13. Changes to these terms
We may update these terms. We will give reasonable notice of material changes, and the date at the top shows the current version. If you continue to use the service after a change takes effect, the updated terms apply. If you do not accept them, you may cancel and delete your account.
14. Governing law and disputes
These terms are governed by the law of Slovakia. If you are a consumer resident in the EU, you also keep the protection of the mandatory law of your own country, and you may bring proceedings in your own courts.
We would rather resolve problems directly — please contact us first at info@funkum.studio. Consumers may also use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr.
